Steps to follow when buying land in Kenya.

Buying land in Kenya has become a complex transaction over time with the rising cases of fraud .   1. When buying land, the purchaser should conduct a reconnaissance to identify the land and see if it is fit for purchase.
  2. Conduct a thorough land title search at the land registry in order to validate the ownership of the land to be bought.
  3. Establish the price by preparing an offer through an advocate. This letter of offer indicates the details of the buyer and the purchaser, attributes of the property and the price of the land .
  4. The seller and purchaser should come into terms with the price of the land by signing the sale agreement which is drafted by the seller’s lawyer. Both parties agree on the deposit to be paid and how the full amount will be completed.
  5. Acquisition of two maps, from a surveyor or from the ministry of lands. One map is drawn to scale while the other not to scale showing the neighboring parcels.

  7. Obtain Land Control Board Clearance. This board consists of county commissioners and elders, who give the final permission for the land to be sold. By filling the land consent form, they verify that the land is sold with the consent of the spouse or any other related parties.
  8. The purchaser applies for a valuation to the government valuer who later prepares a valuation report. This is done to ascertain the value of the land for the purposes of stamp duty.
  9. Payment of Stamp Duty which is the tax levied on all lands which is usually 4% of the land value in urban areas and 2% for those in rural areas.
